These Terms of Service (“Terms”) govern your use of the Traqqo mobile application (“App”) operated by Traqqo (“we”, “our”, or “us”). By accessing or using the App, you agree to be bound by these Terms.
1. Service Description
Traqqo is a client and session management platform designed for independent personal trainers and their clients. The App provides tools for:
- Managing client information and relationships.
- Scheduling and tracking training sessions.
- Setting and monitoring client goals with progress tracking.
- Creating and managing session packages.
- Collecting payments through integrated payment processing (Stripe).
- Sending push notifications for session reminders and updates.
- One to one messaging between a trainer and a client, including sharing photos.
- Sharing progress photos on training journal posts and goal updates.
2. Account Requirements
To use Traqqo, you must:
- Be at least 18 years of age.
- Provide accurate, current, and complete registration information.
- Maintain the security of your account credentials.
- Promptly update your account information if it changes.
- Accept responsibility for all activity that occurs under your account.
You may not create an account on behalf of another person without their authorization. Each individual should have their own account.
3. Plans and Payments
Free Plan
Traqqo offers a free plan with limited features, including a maximum of 5 active clients per trainer.
Pro Plan
The Pro plan offers unlimited active clients and additional features. It is a paid, auto-renewing subscription sold as an in-app purchase through the App Store on iOS and Google Play on Android. Pro is offered as a monthly or an annual subscription, and the price in your local currency is shown in the App before you confirm the purchase.
- Payment is charged to your Apple Account or Google Account when you confirm the purchase.
- The subscription renews automatically for the same period unless auto-renew is turned off at least 24 hours before the end of the current period.
- You can manage or cancel the subscription at any time in your Apple Account or Google Account settings. Cancelling stops future renewals; Pro stays active until the end of the period you have already paid for.
- Refunds are handled by Apple or Google under their own policies, not by us.
- If your subscription ends while you have more than 5 active clients, your existing data is preserved, but you will not be able to add new clients until you are back within the free-plan limit or you resubscribe.
Subscriptions purchased through the App Store are additionally governed by Apple’s standard Licensed Application End User License Agreement. Where that agreement conflicts with these Terms in respect of your licence to use the App, the Apple agreement prevails.
Payment Collection (Trainer ↔ Client)
Separately from the Pro subscription, trainers may collect payments from their own clients for sessions and session packages, in cash, by bank transfer, or by card. Card payments are processed through Stripe Connect and are available on the Pro plan; Traqqo takes no commission on them. All card processing is handled by Stripe and subject to Stripe’s terms of service. We are not responsible for payment disputes between trainers and their clients.
4. Acceptable Use
You agree not to:
- Use the App for any illegal or unauthorized purpose.
- Share your account with others or allow multiple individuals to use a single account.
- Attempt to access, tamper with, or use non-public areas of the App or our systems.
- Upload malicious content, viruses, or harmful code.
- Harass, abuse, or harm other users.
- Use the App to collect, store, or process sensitive health information beyond what is necessary for personal training (the App is not a medical device and should not be used as one).
- Scrape, copy, or extract data from the App through automated means.
- Misrepresent your identity or affiliation.
4.1 User Content
Parts of the App let you create and share content with the person you are connected to: chat messages and photos, training journal posts and photos, goal updates and photos, and your profile photo. We call all of this "User Content". You are responsible for the User Content you create, upload, or send.
Traqqo is a private, one to one tool. Your User Content is visible only to you and to the trainer or client you are connected with. The one exception is your profile photo, which is visible to anyone who can see your profile in the App.
4.2 Objectionable Content
You may not create, upload, send, or store User Content that is objectionable. Objectionable content includes, without limitation:
- Nudity, sexually explicit material, or sexually suggestive material involving any person.
- Any sexual content involving a minor, and any other content that sexually exploits or endangers a child.
- Graphic violence or gore, and content that promotes, glorifies, or incites violence, self harm, or suicide.
- Harassment, bullying, stalking, threats, or intimidation directed at any person.
- Hate speech, and content that attacks or demeans a person or a group on the basis of race, ethnicity, national origin, religion, disability, age, sex, gender identity, or sexual orientation.
- Content that promotes illegal activity, illegal drugs, or the sale of regulated goods.
- Content that infringes another person's intellectual property, privacy, or publicity rights.
- Photographs or recordings of another person made or shared without that person's consent.
- Spam, scams, phishing, and deceptive commercial content.
4.3 Zero Tolerance
We operate a zero tolerance policy for objectionable content and for abusive users. There is no warning system and no strike count. Posting objectionable content is grounds for the immediate removal of that content and the immediate suspension or permanent termination of your account, at our sole discretion, whether or not the content was reported to us.
4.4 Reporting, Removal, and Blocking
Every chat message, journal post, and goal update in the App can be reported from inside the App. Press and hold a chat message, or tap the "..." button on a post, and choose Report. You can also report a person directly from the menu at the top of your conversation with them.
We review every report. Within 24 hours of receiving a report, we will act on any User Content we find to be objectionable, by removing the content, by ejecting the user who provided it, or both. We may also act on our own initiative if we become aware of objectionable content by other means.
You can block the person you are connected with at any time, from the menu at the top of your conversation with them or from their profile screen in the App. Blocking immediately ends your connection with that person, stops any further messages and photos from them, hides the conversation, and prevents that person from inviting you again. You can review and undo your blocks under More, Blocked users.
If you cannot reach the reporting tools in the App, or you need to report something urgently, email us at info@traqqo.com.
4.5 Consent to These Rules
By uploading a photo or any other media to the App you confirm that you have read this section and that your content complies with it.
5. Intellectual Property
The App, including its design, features, and content (excluding user-generated content), is owned by Traqqo and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the App without our written permission.
You retain ownership of the User Content you create within the App, including client data, session notes, goal information, journal entries, chat messages, profile photos, and any photographs or other media you upload. By creating or uploading User Content, you grant us a worldwide, non exclusive, royalty free licence to host, store, copy, transmit, resize, re encode, and display that content, and to create derived copies such as thumbnails and previews, for the sole purpose of operating, securing, and providing the App to you and to the people you have chosen to share it with. That licence also covers the limited review and retention of reported content for the purposes described in section 4.4.
The licence ends when you delete the content, except for copies held in routine backups for a limited period and copies we are required to retain by law or to document a violation of section 4.
You confirm that you hold the rights to the User Content you upload and that you have the consent of every person who appears in a photograph you upload.
6. Limitation of Liability
To the maximum extent permitted by law:
- The App is provided “as is” and “as available” without warranties of any kind.
- We do not guarantee that the App will be uninterrupted, error-free, or secure.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
- Our total liability for any claims related to the App shall not exceed the amount you paid us in the 12 months preceding the claim.
- We are not responsible for the actions, content, or services of third-party providers (including Stripe).
7. Data and Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you agree to our Privacy Policy.
8. Termination
- You may delete your account at any time through the App’s account settings. Account deletion is permanent. See Delete your account for exactly what is removed and what is kept.
- We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law.
- We may remove User Content and suspend or permanently terminate your account immediately and without prior notice for a violation of section 4.
- Upon termination, your right to use the App ceases immediately.
- Provisions that by their nature should survive termination (including limitations of liability and intellectual property) will survive.
9. Modifications to the Service
We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting a notice in the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which Traqqo operates, without regard to conflict of law principles.
12. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.
